Coronavirus (Covid-19)

Like many countries in the world, Romania is being affected by the Covid-19 situation.

As of October 25, 2021 Romania has declared a state of public health emergency
to reduce the impacts of COVID-19 on the health care system, stop the spread, and increase vaccination rates.

The National Centre for monitoring and control of transmissible diseases
and the local health authorities are monitoring the situation closely.
The following rules / public health restrictions are in effect:
* Locals and visitors must wear a mask when in indoor and outdoor public spaces.
* An EU covid digital certificate in required to access all non-essential public institutions and stores.
Access to pharmacies and food stores (except those located in shopping malls) does not require proof of vaccinations.

*Indoor entertainment, event and recreation facilities
will operate at limited capacity, between the hours of 5 a.m. and 9 p.m.:
~ Restaurants – 50% capacity, for indoor dining.
~ Movie theatres, fitness facilities and playgrounds – 30% capacity.
Beginning October 25 until November 30, 2021:
~~ Bars and clubs will be closed
~~ Private events will be prohibited.

Non-essential travel is prohibited betweenthe hours of 10 p.m. and 5 a.m. (next day).

Traveling to Romania from abroad:
Effective October 24, 2021,

visitors and Romanian citizens,
arriving from the following countries (“red” / high-risk zones):

Luxemburg, Maldives, Monserrat, the Netherlands, Northern Macedonia, Palestina, Russia,
Saint Lucia, Sint Maarten, Thailand, Trinidad & Tobago, Turks si Caicos, U S Virgin Islands.
must self-quarantine for 14 days
only if not vaccinated or
cannot present proof of a negative Covid-test
performed 72 hours or less before departure to Romania.

The duration of self-quarantine can be reduced from 14 to 10 days

Before entering Romania, visitors and residents

Entry requirements for children and teenagers:
(National Inspectorate for Emergency Situations – Decision # 43 / July 1, 2021)

Children 0 to 3 years-old:
there is no need for a negative RT-PCT test

Children and teenagers 3 to 16 years old:
a negative PCR test is required.
Test must have been performed no more that 72 hours
before the date of entry into Romania.

There are no restriction for visitors residing in – or arriving from –
countries not mentioned above (red and yellow zones).

To qualify for the fully vaccinated traveler exemption, you must: • have no signs or symptoms of COVID-19
• have received the full series of an accepted COVID-19 vaccine or a combination of accepted vaccines
• have received your last dose at least 14 days prior to the day you enter Romania
(i.e. . if your last dose was on August 1, then August 16 would be the first day that you meet the 14 day condition.
• meet all other Romania entry requirements (passport or EU ID, visa if needed …)

Accepted COVID-19 vaccines in Romania:
• Pfizer-BioNTech (Comirnaty, tozinameran, BNT162b2)
• Moderna (mRNA-1273)
• AstraZeneca/COVISHIELD (ChAdOx1-S, Vaxzevria, AZD1222)
• Janssen/Johnson & Johnson (Ad26.COV2.S)
The list of accepted vaccines may expand in the future.

All other Covid vaccines are not currently accepted for fully vaccinated status in Romania.

There are no exemptions from testing or quarantine for partialy-vaccinated travelers
(travelers who haven’t received the full series of a vaccine or a combination of vaccines
accepted by the Government of Romania).

Note:
All vaccinated visitors will still need to comply with any testing requirements imposed by airlines and/or
government of the contry of departure (and transit).

Passengers arriving at Bucharest International Airport, from ‘yellow’ zones,
can enter Romania using the ‘Green Lane’, dedicated to vaccinated visitors,
if are vaccinated and can present an European EU Digital COVID Certificate
or
can present proof of a negative PCR test
(performed less than 72 hours before arrival to Bucharest)

Passengers arriving at Bucharest International Airport, from ‘red’ zones,
can enter Romania using the ‘Green Lane’ dedicated to vaccinated visitors
if are vaccinated and can present an European EU Digital COVID Certificate.

Digital Covid Certificates issued by the UK authorities cannot grant (are not accepted for)
entry into Romania via the “Green (Low-risk) Lane”.

It is expected that most restrictions will be lifted by the end ofNovember 2021.

Romania adopts its own national classification of risk areas,
hence travel restrictions for Romania are not based on the common “EU Traffic Lights” map.

“Green” areas: countries where the cumulative incidence rate of new COVID-19 cases in the last 14 days
is less than or equal to 1,5 per 1000 inhabitants;

“Yellow” areas: countries where the cumulative incidence rate of new COVID-19 cases in the last 14 days
is between 1,5 and 3 per 1000 inhabitants;

“Red” areas: countries where the cumulative incidence rate of new COVID-19 cases in the last 14 days
is greater than or equal to 3 per 1000 inhabitants.

The distinction is defined as follows:
Travellers who have received their final vaccination for COVID-19 more than 10 days ago,
are exempt from quarantine. It is required to show proof of vaccination, including the dates.

Travellers arriving from countries classified as “green”
can enter Romania without being subject to any isolation or test requirement.

Travellers arriving from countries classified as “yellow“,
who do not provide a pre-departure negative PCR test taken within 72 hours prior to arrival,
are subject to a 14-day quarantine.
Children under 6 years old are exempted from the PCR test requirement.
The quarantine period may be shortened by taking a PCR test no less than 8 days after arrival.
If the result of this test is negative, the period of quarantine can end on day 10.

Travellers coming from a “red” area (RO classification),
need to do 14 days of quarantine, even if they present a negative test
(even if it is an EU Digital Covid test certificate).
Children between 6 – 16 years old can be exempt from quarantine
if they present a test certificate (PCR, taken the latest 72h in advance).
Children under 3 are except from quarantine and testing requirements.
Some exceptions apply for short stays
(less than 72h, with a negative PCR test taken the latest 72h in advance),
imperative reasons, transit, cross-border workers.

Romania’s currency (Lei) is not readily available abroad.
If you do not wish to keep your leftover Romanian Lei, please make sure that,

Bucharest Taxi

In the past years, the RomaniaTourism has received quite a few complaints regarding Bucharest taxi drivers who overcharged customers by not using the meter or employing malfunctioning meters.
Drivers approaching you at the airport or at the train station (Gara de Nord) in Bucharest are likely to inflate their rates; please be aware and try to avoid them.

Taxis can be summoned by telephone or hailed on the street. Confirming the cost of the ride with the driver, before starting the trip, is always a good idea.

Taxi tariffs can vary from company to company.

Driving in Romania

Most major tourist attractions in Romania are easily accessible by public transportation but travel by car is perhaps the best way to discover Romania’s charming villages and to reach attractions located in areas with limitted bus
or train service.

In some areas of Romania, conditions of roads, the number of slow moving vehicles and even the level of adherence to traffic regulations and common road courtesies may be different from what you are familiar with in the USA or Canada.

We are not aware of any major incidents regarding driving in Romania but feedback from a few U.S. and Canadian travelers have indicated that some Romanian drivers have a competitive driving style (improper passing / cutting into another car’s path and tailgating flash of the headlamps are not uncommon).

While in North America flashing the headlamps is considered rude in Europe a quick flash of the headlamps is sufficient to get the car lead to move on the first lane of the (multi-lane) road.

In rural areas be ready to share the road with slow-moving vehicles, including horse-drawn wagons.

A number of roads are under construction.
Signage and safety studs may be inferior to those used in North America.

The numerous photo opportunities offered by Romania’s scenic countryside may make you to stop more often than planned and driving to your destination may take longer than expected.

Romanian Tour Operators, Travel Agencies and Freelance Guides must be licensed
by the Romanian Ministry of Tourism

Be particularly cautious if:

– the Website of a travel company or a freelance guide does not indicate a physical address,
– hotel rates and prices for similar services are significantly lower then those offered by other companies,
– full payment – in cash / wire transfer – is being asked when making the reservation or long before the beginning of trip, especially for services that must not be paid in advance by the travel company (meals, guide services, ground transportation).

Rules for travellers arriving into Poland from outside the European Union, the Schengen Area and Turkey.

Persons vaccinated against COVID-19 are exempt from quarantine. This applies to persons who have a certificate of vaccination with a vaccine which has been granted a marketing authorisation within the European Union. Full vaccination is recognised 14 days after completion of the vaccination process.

Travellers, regardless of their means of transport (collective or individual, including crossing the border on foot), are subject to a 10-day entry quarantine, unless they meet one of the following conditions:

• they have completed a full vaccination cycle, and 14 days (counting from the day following the date of the final dose) have passed since their final dose. Their vaccination is confirmed by an EU Digital COVID Certificate or by another document in Polish or in English confirming vaccination with a vaccine which has been granted a marketing authorisation within the European Union,
• they are children not older than 12 travelling under the guardianship of adults who are vaccinated against COVID-19,
• they have recovered from a SARS-CoV-2 infection (so-called “convalescents”) at most 6 months before the day on which they cross the border of the Republic of Poland. Convalescents are obliged to present a document confirming recovery from the disease, issued in Polish or in English, e.g. an EU Digital COVID Certificate,
• they are subject to exemptions listed in § 3 of the Regulation of the Council of Ministers of 6 may 2021 on the establishment of certain restrictions, orders, and prohibitions in connection with the occurrence of an epidemic.

Travellers subjected to quarantine in Poland will be able, not earlier than on the 8^th day counting from the day following the date on which the border was crossed, to undergo a test, with negative result meaning exemption from the quarantine. When calculating the 7-day quarantine period, the expiry of which entitles to a diagnostic test on the eighth day, the day on which the border of the Republic of Poland was crossed is not taken into account.

Example: If you crossed the Polish border on July 1st, you can undergo a test which may exempt you from quarantine on July 9th.

• Test type: RT-PCR or antigen test performed by a laboratory.
• Tests are not financed from public funds.

The above obligation does not apply to entries and arrivals from:

• Member States of the European Union: Austria, Belgium, Bulgaria, Croatia, Republic of Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden,
• 4 non-EU countries which are part of the Schengen Area – Iceland, Liechtenstein, Norway and Switzerland,
• Turkey, with which a special agreement has been concluded.

Important! Persons who stay within the Republic of Poland for not longer than 24 hours after arrival and have a flight ticket confirming departure from the Republic of Poland within 24 hours are exempt from the obligation to undergo quarantine.

Passenger Locator Form

From July 17th onwards, any person who crosses the state border of the Republic of Poland by plane is obliged to fill in, prior to check-in, a Passenger Locator Form, either electronically or, if that’s not possible, on paper using the form provided by the on-board staff.

The State Regional Sanitary Inspector (sanepid) with authority over the traveller’s place of residence or stay acts as the data controller with respect to Locator Forms.

EU Digital COVID Certificate

EU Digital COVID Certificates are issued by the Ministry of Health. A vaccination certificate is issued:

1. in electronic form,
2. in printed form;

• by entities which carry out the COVID-19 vaccinations,
• by a primary care physician or a primary care nurse.

Since June 13, 2020, there are no border controls at the internal borders with the Republic of Poland. The border can be crossed at any place both in the entry and exit direction from Poland. The restrictions, including restrictions on the entry of foreigners into Poland  still apply at the external border.

Conditions of entry into Poland

At present, the external border in the direction of entry to Poland in accordance with the § 3 section 2 of the Regulation of the Minister of the Interior and Administration of 13 March 2020 on the temporary suspension or restriction of border traffic at specific border crossing points may only be crossed by the defined categories of travellers:

1. citizens of the Republic of Poland,
2. foreigners who are spouses or children of Polish citizens or remain under constant care,
3. foreigners holding the Card of the Pole,
4. members of diplomatic missions, consular posts and representatives of international organizations and members of their families, as well as by other persons crossing the border on the basis of a diplomatic passport;
5. foreigners having the right of permanent or temporary residence on the territory of the Republic of Poland, i.e.:

• persons holding a residence card issued for the purpose:
  • temporary residence permit,
  • a permanent residence permit,
  • long-term resident’s EU residence permit,
  • a permit to stay for humanitarian reasons,
  • refugee status,
  • granting subsidiary protection,
• about the people who have:
  • permission to stay as a family member of an EU citizen,
  • permission for permanent residence of a family member of an EU citizen;

6. foreigners who have the right to work in the territory of the Republic of Poland and who simultaneously perform/are performing work in the territory of the Republic of Poland or during border control present documents which indicate that their work start immediately after crossing the border.

Persons belonging to this category of persons should present during border control documents confirming that the foreigner currently has access to the national labour market and currently benefiting from this access, he/she works in Poland . Depending on the category of foreigner, these will be the following types of documents:

• in the case of third-country nationals who are required to have a work permit –
  work permit, seasonal work permit, certificate of entry in the register on seasonal work, statement on entrusting work to a foreigner on the territory of the Republic of Poland or permit belonging to the category of uniform permits, such as e. g. temporary residence and work permit;
• in the case of foreigners entitled to perform work on the same conditions as Polish citizens – these are, among others, foreigners specified in article 87 section 1 points 1 – 11 of the Act of 20 April 2004 on employment promotion and labour market institutions (e. g. European Union citizens)- e. g. employment contracts, civil law contracts confirming the validity of cooperation with the entity;
• in the case of foreigners performing work in the territory of the Republic of Poland on the basis of secondment – these should be documents confirming the fact of secondment to the territory of Poland, indicating the specific entity to which they were delegated;
• in the case of foreigners exempted from the obligation to have a work permit – documents constituting the basis for this exemption, including contracts confirming work performance;
• in the case of foreigners performing a function in the management board of a legal person – e.g. an extract from the National Court Register .

Foreigners during the border control can provide electronic version, print or scan of original documents such as certificate of entry in the register on seasonal work or statement on entrusting work to a foreigner on the territory of the Republic of Poland

Right to enter to the Republic of Poland of foreigners entitled to perform work also concern the  travellers crossing the border before the day the work should start (indicated in the work permit) in connection with obliged to undergo a mandatory 10-days quarantine.

7. foreigners who operate a means of transport for the transport of persons or goods and their journey takes place as part of professional activities involving the transport of goods or transport of persons;
8. drivers engaged in carriage by road in the context of international road transport or international combined transport operations within the meaning of art. 4 points 2 and 14 of the Act of 6 September 2001 on road transport (Journal of Laws of 2019, item 2140 and of 2020, item 875) travelling in transit through the territory of the Republic of Poland by means of transport other than the vehicle by which road transport is carried out:
   • in order to take the rest referred to in Regulation (EC) No 561/2006 of the European Parliament and of the Council of 15 March 2006 on the harmonisation of certain social legislation relating to road transport and amending Council Regulation (EEC) No 3821/85 and (EC) 2135/98, as well as repealing Council Regulation (EEC) No 3820/85 (OJ L 102, 11.04.2006, p. 1, as amended 2)), in the territory of the country of stay,
   • after collecting the rest referred to in the Regulation mentioned above, and after a break in the performance of work in the circumstances indicated in art. 31 section 1 of the Act of 16 April 2004 on working time of drivers (Journal of Laws of 2019, item 1412);
9. pupils learning in the Republic of Poland, after having been documented to a Border Guard oficer that they are learning in the Republic of Poland and their guardians who crossing the border together with students in order to enable them to study

accordance with the provisions of the Act of 14 December 2016 on the Educational Law, the status of a pupil (listener – as in accordance with Article 4 point 20 – a pupil is also
a listener and pupil) is owned by persons learning on the territory of the Republic of Poland in public or non-public schools:

– primary and secondary schools for children and youth (i. e. eight-year primary school or post-primary school – i. e. four-year general secondary school, five-year technical school, three-year vocational school, three-year special school for work preparation),

– second-level vocational schools and post-secondary schools (i. e. a two-year industry school of II degree, post-secondary school for persons with secondary education or industry secondary education of no more than 2.5 years)

– for adults (primary school and general secondary school, where a separate education organisation applies and to which adults are admitted).

, the status of a pupil is also assigned to pupil of a vocational qualification course – a form of extracurricular adult education. It is intended for all persons who are over 18 years old and have completed a lower secondary school or an 8-year primary school. Training in a vocational qualification course is based on the curriculum of the profession and prepares for a vocational examination.

10. nationals of Member States of the European Union and of the European Free Trade Agreement (EFTA) – Parties to the Agreement on the European Economic Area or the Swiss Confederation and their spouses and children;

11. foreigners holding a permanent residence permit or a long-term resident’s European Union residence permit, on the territory of other Member States of the European Union, a Member State of the European Free Trade Agreement (EFTA) – Parties to the Agreement on the European Economic Area, the Swiss Confederation or the United Kingdom of Great Britain and Northern Ireland and their spouses and children, in order to travel through the territory of the Republic of Poland, to their place of residence or stay;

12. students, participants in post-graduate studies, specialist education and other forms of education, as well as doctoral students studying in the Republic of Poland, after having documented their education in the Republic of Poland to a Border Guard officer.

Participants of specialist education are those of colleges in which specialist education lasts no less than 3 semesters and allows to obtain a full qualification at level 5. Polish Qualification Framework (at 5. the level of qualification shall be a diploma of graduation from a teacher‘s college, a diploma of graduation from a teacher‘s college of foreign languages, a diploma of graduation from a college of social workers).

• in other forms of training as defined in the Act of 20 July 2018 on Law on Higher Education and Science refers only to education in the higher education system, e. g. students of part-time studies, including studies conducted on-line, participants of preparatory courses to study in Polish, language courses conducted by universities. The term refers only to education in the higher education system.

13. scientists conducting research or development works in the Republic of Poland, having documented to a Border Guard officer the conduct of scientific research or development works in the Republic of Poland; specialists in a specific field of science employed in a scientific position at a university, college or research institute, who carry out research work on selected issues.
14. foreigners travelling by aircraft within the meaning of Article 2 point 1 of the Act of 3 July 2002 – Aviation Law (Dz. U. of 2019, item. 1580 and 1495 as well as from 2020 pos. 284 and 1378) operating an international flight who:

• a) are nationals of: Georgia, Japan, Canada, New Zealand, the Kingdom of Thailand, the Republic of Korea, the Republic of Tunisia, the Commonwealth of Australia, Israel, United States of America, Republic of Turkey or
• b) have the right to reside in the territory of the States referred to in points (a)
• c) foreigners who stays, upon arrival by plane on the territory of the Republic of Poland for no longer than 24 hours and holds an air ticket confirming departure from the territory of the Republic of Poland within 24 hours of arrival on the territory of the Republic of Poland, counting from the moment of arrival on the territory of Poland,

15. persons crossing the border of the Republic of Poland on the basis of a national repatriation visa or a visa to come to the territory of the Republic of Poland as a member of the repatriate‘s close family;
16. foreigners who arrive in connection with participation, as a competitor, training staff member, doctor, physiotherapist or judge,in international sports competitions organised on the territory of the Republic ofPoland by an international sports federation activ  in Olympic or Paralympic sport or other sport recognised by the International Olympic Committee or organised by an international sportsorganisation ofcontinental range belonging to such federation or Polish sports associationas and accredited journalist, af er documenting to the Border Guard officer the fact of taking part in the competition, the date and nature of participation by a relevant letter issued by the organiser of the competition or certified by a Polish sports association competent in a given sport.
17. foreigners crossing the border of the Republic of Poland on the basis of  humanitarian visa
18. (from 09/22/2020) citizens of the Republic of Belarus;

18a. citizens of Ukraine;

15. fishermen within the meaning of the article 2 point 9 of the Act of 11 September 2019 on work on board a fishing vessel (Dz.U. pos. 2197) or seafarers within the meaning of the article 2 point 3 of the Act of 5 August 2015 on worka at sea (Dz.U of 2020 pos.1353), including seafarers employed under the conditions laid down in article 46 or 108 of the Act on worka at sea, and also:

• seafarers and fishermen travelling to the port for employment purposes (work onboard a ship) and to their place of residance or stay after the completion employment, even they are travelling by different means of transport – also through the territory of the Republic of Poland
• persons working on a ship or offshore platform on the basis of documents different than sailor’s employment contract

20. foreigners holding visa issued for the purpose of participation in ‘’Poland. Business Harbour” programme
21. foreigners coming to the Republic of Poland for economic purposes upon written invitation containing an indication of the economic purpose, issued by the entity entered in the National Register Court or to the Central Register and Information on Economic Activity, after documenting a Border Guard officer of these circumstances.
22. citizens of the United Kingdom of Great Britain and Northern Ireland and their spouses and children,
23. persons whose arrival takes place in connection with participation in an international competition or a music festival organized in the territory of the Republic of Poland by a state or local government cultural institution, as a participant, performer artist, juror, accredited journalist or a guardian of the participant or performer artist after documenting to the Border Guard officer the fact of taking part in the competition or festival, the date and nature of participation by a relevant letter issued by the organiser of the event,
24. – participants of Erasmus + and European Solidarity Corps projects, after documenting their participation in a given project to a Border Guard officer
25.  participants of projects:

a. realised within the framework of the Polish – Ukrainian Exchange of Youth Council, together with their guardians,

b. within the scope of the cooperation of children and youth, realized and financed on the basis of art. 167 of the act of 14 December 2016 – Education law ( Journal of Laws of 2021, item 1082), together with their guardians,

c. within the scope of cooperation of schools functioning within education systems of other countries or social organisations registered abroad together with the schools of the Republic of Poland on the basis of art. 47 par. 3 point 2 letter e of the act of 14   December 2016 – Education Law,

–  after prior submission  by the Ministry of Education and Science of the information of planned entry together with data of participants –  and in case of project referred to in letter a and b also their guardians – to the Border Guard.

26. minor foreigners who are children or remain under the permanent care of the foreigners in question in points 3, 5 or 6.

Persons who do not meet at least one of the above conditions do not currently have the right to enter the territory of the Republic of Poland.

In particularly justified cases (mainly due to humanitarian reasons), the commanding officer of the Border Guard Post, after obtaining the consent of the Commander-in-Chief of the Border Guard, may allow foreigners who do not meet the entry requirements set out in the Regulation of the Minister of Internal Affairs and Administration of March 13, 2020 on temporary suspension or restriction of border traffic at specific border crossing points, to enter the territory of the Republic of Poland.

The decision on permitting entry is made each time by the commanding officer of the Border Guard Post during the border check, after the necessary control and verification activities have been carried out, in particular after verification of the documentation submitted by the foreigner.

This means that a foreigner cannot apply for such a permit earlier.

Special solutions for foreigners

– Extension of stay under visa-free regime, on the basis of visas and residence permits issued by other Schengen States

The provisions of the Act of March 2, 2020 on special arrangements for preventing, counteracting and combating COVID -19, other infectious diseases and crisis situations caused by them, introduced a number of special legal solutions aimed, inter alia, to sort out problems related to, among others with the legality of foreigners’ residence on the territory of the Republic of Poland after the declaration of the state of epidemic emergency. These solutions include:

• extension by law of the periods of validity of temporary residence permits expiring during the period of state of epidemic emergency or state of epidemic  – until the end of the 30th day following the date of cancellation of one of the above-mentioned states, whichever was in force last (art. 15zd section 3 of the Special Act); holders of national visas retain the right to cross the state border and stay in the territory of the Republic of Poland during the period when the state of emergency or state of epidemic is in force, as well as for a period of 30 days after the last state is recalled;
• extension by law of periods of stay and periods of validity of national visas in cases where the last day of the period of stay on the basis of such visas would fall within the period of state of epidemic emergency or state of epidemic  – until the end of the 30th day following the date of cancellation of one of the above-mentioned states, whichever was in force last (Article 15zd section 1 of the Special Act);
• recognition as legal by law the residence of foreigners on the territory of the Republic of Poland in cases where, on the day from which the state of epidemic emergency was announced in connection with SARS-CoV-2 virus infections was first declared, they were staying on that territory on the basis of short-term residence titles , i.e.:

1. under the visa-free regime,
2. on the basis of Schengen visas issued by Polish authorities,
3. Schengen visas or long-term visas issued by other Schengen states,
4. residence permits issued by other Schengen states,
5. long-term visas or residence permits issued by Member States of the European Union which are not countries of the Schengen areas (when, according to the law of the European Union, such visas or documents entitle to stay in the territory of the Republic of Poland,

–  from the day following the last day of legal residence resulting of these titles until the expiry of the 30th day following the date of cancellation of the state of epidemic emergency or state of epidemic, whichever was in force last (Article 15z1 section 1 of the Special Act).

The above provision (Article 15z1) has effect only with the respect to the abovementioned documents the holders of which were on the territory of the Republic of Poland on the day on which the first declaration of the state of epidemic emergency was announced connected with SARS-CiV-2 virus infection and is not tantamount to the prolongation of any of the above-mentioned visas or documents or extension of authorised stay under visa-free regime.

The use of this legal basis for stay in the territory is in no way conditional on the submission of any applications, issuing permits or documents, and no administrative decision is issued for this effect to occur. There is no need to obtain a visa extension under the provisions of the Act on Foreigners.

– Extension of stay on the basis of a declaration of employment, work permit, residence cards and other

• extension by law of the periods of validity of work permits and seasonal work permits, as well as periods of permitted work on the basis of declarations of entrusting work to a foreigner, entered in the register of declarations – until the end of the 30th day following the date of cancellation of one of the states, whichever was in force last (Article 15zzq of the Special Act);

• enabling changes in the conditions of work performed by foreigners specified in work permits, seasonal work permits, declarations on entrusting work to a foreigner, entered in the register of declarations, temporary residence and work permits, temporary residence permits for the purpose of performing work in a profession requiring high qualifications, temporary residence permits for the purpose of work under an intra-corporate transfer or temporary residence permits for the long-term mobility of a managerial staff member, specialist or trainee employee, as part of an intra-corporate transfer, as well as in the documents attached to the notice of intention to use from the short-term mobility of a managerial staff member, specialist or trainee employee, within the framework of an intra-corporate transfer – if this change is a result of the entity which entrusts the work (or the host entity with its registered office in the territory of the Republic of Poland) with individual powers aimed at protecting jobs in crisis conditions and preventing the spread of SARS-CoV-2 virus, regulated in art. 3, art. 15g section 8, art. 15x section 1 and art. 15zf section 1 of the Special Act (Article 15z5 of the Special Act);
• providing access to seasonal work within the meaning of art. 88 section 2 of the Act of 20 April 2004 on employment promotion and labour market institutions (Journal of Laws of 2019, item 1482, as amended) for foreigners who in the period following March 13, 2020 had access to the Polish labour market on the basis of a work permit, seasonal work permit, prolongation of the work permit, prolongation of the seasonal work permit or statement on entrusting work to a foreigner, entered in the register of statements – in the period of state of epidemic emergency or state of epidemic and in the period of 30 days immediately following the cancellation of the last of the states;
• extension by law of the periods of validity of residence cards falling within the period of state of epidemic emergency or state of epidemic – until the end of the 30th day following the date of cancellation of one of the states, whichever was in force last (Article 15z2 section 1 of the Special Act); a foreigner is entitled to use the document they hold as valid despite the expiry date specified therein. This means that holders of such documents retain the right to cross the state border;
• extension by law of the periods of validity of Polish foreigner’s identity documents and documents confirming the possession of a permit for tolerated stay (tolerated stay permit) until the end of the 30th day following the date of cancellation of one of the states, whichever was in force last (Article 15z6 sections 3 and 5 of the Special Act);
• extension by law of the periods of validity of documents issued for a limited period of time issued to citizens of the Member States of the European Union and of the European Free Trade Association (EFTA) – Parties to the contract on the European Economic Area or the Swiss Confederation and their family members who are with them or who join them, i.e. documents confirming the right of permanent residence, residence cards of an EU citizen’s family member and permanent residence cards of an EU citizen’s family member, falling within the period of state of epidemic emergency or state of epidemic – until the end of the 30th day following the date of cancellation of one of the states, whichever was in force last (Article 15z6 section 1 of the Special Act);
• extension by law of the deadlines for submitting an application for a temporary residence permit, permanent residence permit, long-term resident’s EU residence permit, for visa extension or for extension of stay as part of visa-free regime falling within the period of state of epidemic emergency or state of epidemic – until the end of the 30th day following the date of cancellation of one of the states, whichever was in force last (Article 15z of the Special Act);
• extension by law of the dates of leaving the territory of the Republic of Poland resulting from art. 299 section 6 of the Act of December 12, 2013 on Foreigners (Journal of Laws of 2020, item 35) falling within the period of state of epidemic emergency or state of epidemic – until the end of the 30th day following the date of cancellation of one of the states, whichever was in force last (Article 15zza of the Special Act);
• extension by law of the periods of voluntary return defined in the decisions on imposing the return obligation, falling within the period of state of epidemic emergency or state of epidemic – until the end of the 30th day following the date of cancellation of one of the states, whichever was in force last (art. 15zzzb of the Special Act);
• extension by law of the periods of validity of temporary foreigner’s identity certificates (known as TZTC) falling within the period of state of epidemic emergency or state of epidemic – until the end of the 30th day following the date of cancellation of one of the states, whichever was in force last (Article 15z3 section 1 of the Special Act).

Residence of EU/EEA/Switzerland citizens and the coronavirus epidemic

EU/EEA/Switzerland nationals and their family members who are not EU/EEA/Switzerland nationals may reside in Poland for up to 3 months without fulfilling any residence conditions other than holding a valid travel document. An EU/EEA/Switzerland citizen may hold another valid document proving his identity and nationality. Their family members who are not EU/EEA/Switzerland nationals should have a visa to enter Poland unless they are exempt from this requirement.

Residence of more than 3 months

A citizen of the EU/EEA/Switzerland is entitled to stay for more than 3 months if he fulfils one of the following conditions:

1. is an employee or self-employed person on the territory of Poland;
2. has sufficient financial resources to support itself and its family members on the territory of Poland so as not to be a burden on social assistance and adequate health insurance;
3. studies or receives vocational training in Poland and has sufficient financial resources to support himself and his family members on the territory of Poland so as not to be a burden on social assistance and has adequate health insurance;
4. is the spouse of a Polish citizen.

If the stay in Poland lasts longer than 3 months, the EU/EEA/Switzerland citizen and his/her family member must register their stay. However, a family member who is not an EU/EEA/Switzerland citizen is obliged to obtain a residence card for the EU citizen‘s family member. These formalities can be carried out in the voivodship office competent for the place of residence of a given person. The application shall be submitted in person, not later than on the day following the expiry of 3 months from the date of entry into the territory of Poland.

The provincial offices have suspended direct customer service. Therefore, at present it is not possible to register the residence, obtain a certificate of registration of the residence of an EU citizen, issue a residence card of an EU citizen‘s family member, as well as documents confirming the right of permanent residence on the territory of Poland.

It should be pointed, however, that the residence rights of EU/EEA/Switzerland citizens and their family members exercising their freedom of movement on the territory of Poland are granted by law if the conditions of the right of residence are met. They do not depend on registration of residence or obtaining a residence permit.

Extension by law of the periods of validity of issued documents

The current legislation provides for the legal extension of the following documents issued to EU/EEA/Switzerland nationals and their family members who reside with or join them:

• documents confirming the right of permanent residence,
• residence cards of an EU citizen‘s family member,
• permanent residence cards of an EU citizen‘s family member.

In the same way as the other anti-crisis solutions concerning the legal extension of validity periods of documents, if the end of the validity period of one of the above mentioned documents is not valid, the validity period of the documents will be extended by law. documents will fall within the period of an emergency or epidemic condition, it will be extended until the 30th day following the date of cancellation of that condition (emergency or epidemic), which will be last in force. At the same time, this extension will not create a basis for the exchange or issuance of a new document.

Certificates of registration of residence of EU citizens as documents of unlimited duration are not covered by this regulation.

If you are traveling, check with your airline before going to the airport and remember that The use of mask is mandatory in all public outdoor and closed spaces if it is not possible to maintain the safety distance. Follow the hygienic measures, keep the physical distance of 1.5 meters with anyone and come to collect your luggage individually.

Can I enter France?

If you are vaccinated

If you are vaccinated, you can travel to France with no restrictions linked to health conditions.

The measures applicable to vaccinated adults also apply to any minors accompanying them, whether they are vaccinated or not. You can therefore travel with your underage children, whether they are vaccinated or not, and they will not need to self-isolate. Unvaccinated children aged 12 and over will need to present a negative test result as described below.

Travel documents if you are vaccinated:

• proof of vaccination. It will only be valid if it proves that you are fully vaccinated, i.e.:
  • Seven days after the second shot for two-shot vaccines (Pfizer, Moderna, AstraZeneca (Vaxevria and Covishield));
  • Four weeks after the shot for one-shot vaccines (Johnson & Johnson);
  • Seven days after the shot for vaccines administered to people who have already had COVID-19 (only one dose is necessary).
    Only vaccines authorized by the European Medicines Agency (EMA) (Pfizer (Comirnaty), Moderna, AstraZeneca (Vaxzevria), Johnson & Johnson (Janssen)), or AstraZeneca (Covishield) will be accepted.
  • Seven days after a booster ARNm dose (Moderna or Pfizer) after two shots of a vaccine on the WHO’s health emergencies list (Sinovac/Coronavac or Sinopharm/BBIB-PVeroCells)
• a sworn declaration, which you can download from the Interior Ministry’s website stating that
  • you have no symptoms of COVID-19 infection;
  • to your knowledge, you have not been in contact with a confirmed case of COVID-19 in the 14 days prior to your journey.

If you are not vaccinated

A list of countries of departure has been drawn up on the basis of the health indicators. The lists of countries can be altered based on changes in the epidemic situation.

Specific rules apply to road hauliers (in French and English).

If you are not vaccinated and you arrive from a “green” country

Upon boarding, each traveller aged 12 and over must present a negative PCR or antigenic test taken less than 72 hours before the flight. If you are travelling from Romania, your test must be taken less than 24 hours before the flight.

If you have previously contracted COVID-19, instead of a negative test result you may present a certificate of recovery dated more than 11 days and less than 6 months prior to the date of arrival. A certificate of recovery is a document issued to persons who have contracted COVID-19, upon presentation of a positive RT-PCR or antigenic test.

This will not apply to:

• trips by residents of cross-border areas (border within a 30 km radius of your residence, and for a duration of less than 24 hours).
• work-related trips, the urgent or frequent nature of which makes them incompatible with these tests;
• trips by hauliers carrying out their work.

To avail of the exemptions above, you must have a document proving the reasons for your trip.

If you are not vaccinated and you arrive from an “orange” country

• You can only travel to France if you have pressing grounds for travel. The list of pressing grounds is set out in the certificate of international travel drawn up by the Ministry of the Interior.
• Each traveller aged 12 and over must present a negative PCR test taken less than 72 hours before departure or a negative antigenic test taken less than 48 hours before departure. If you are arriving from the United Kingdom, the PCR or antigenic test must have been taken less than 24 hours before boarding.

If you have previously contracted COVID-19, instead of a negative test result you may present a certificate of recovery dated more than 11 days and less than 6 months prior to the date of arrival. A certificate of recovery is a document issued to persons who have contracted COVID-19, upon presentation of a positive RT-PCR or antigenic test.

• You may be subject to a random test when you arrive in France.
• You must pledge to self-isolate for 7 days.

If you are not vaccinated and you arrive from a “red” country

• You can only travel to France if you have pressing grounds for travel. The list of pressing grounds is set out in the certificate of international travel drawn up by the Ministry of the Interior.
• Upon boarding, each traveller aged 12 and over must present a negative PCR or antigenic test taken less than 48 hours before the flight.
  If you have previously contracted COVID-19, instead of a negative test result you may present a certificate of recovery dated more than 11 days and less than 6 months prior to the date of arrival. A certificate of recovery is a document issued to persons who have contracted COVID-19, upon presentation of a positive RT-PCR or antigenic test.
• You will be tested when you arrive in France.
• You will be subject to a mandatory 10-day quarantine supervised by security forces.

Travel documents if you are not vaccinated

Depending on your circumstances, you must complete and carry some of the following documents in order to board:

• a sworn declaration, which you can download from the Interior Ministry’s website stating that
  • you have no symptoms of COVID-19 infection;
  • to your knowledge, you have not been in contact with a confirmed case of COVID-19 in the 14 days prior to your journey;
  • (if you are aged 12 or over) you agree to submit to a virological RT-PCR test for SARS-CoV-2 upon arrival in France;
  • (where applicable) you pledge to self-isolate for seven days;
  • (for non-vaccinated travellers arriving from a “red” country) you are aware that you will have to quarantine for 10 days upon arrival in France.

• (for non-vaccinated travellers arriving from “orange” or “red” countries) an exempted international travel certificate for Metropolitan France, which you can download from the Interior Ministry’s website. You must present this certificate to travel companies before using your travel ticket, as well as to border control authorities (for travel by air, sea and land, including by rail);

• (for non-vaccinated travellers arriving from a “red” country) proof of location of self-isolation, and where appropriate, access details for inspectors to carry out checks.

If you fail to produce these documents, you will be denied boarding.

Other rules apply to travel to and from French overseas territories (see below).

I am travelling to or from a French overseas territory or Corsica. What are the rules?

Each overseas territory as well as Corsica, sets its own entry conditions and possible restrictions (curfew, lockdowns, etc.) based on the local epidemiological situation. You are therefore highly advised to visit the website of the prefecture or high commission of your destination before you travel.

Travel between Metropolitan France and some overseas territories is only possible if you have pressing grounds for travel.

You must in that case have a travel certificate for overseas territories and Corsica, available on the Interior Ministry’s website.
